These Terms of Service (“Terms”) are a binding agreement between you and GoJas Enterprises LLC, which operates Point Wizard (“Point Wizard,” “we,” “us”), governing your use of our website, apps, and services (the “Service”). By creating an account or using the Service, you agree to these Terms. PLEASE READ SECTION 16 (BINDING ARBITRATION & CLASS-ACTION WAIVER) CAREFULLY — IT AFFECTS HOW DISPUTES ARE RESOLVED.
You must be at least 18 years old and able to form a binding contract in your jurisdiction to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate and kept up to date.
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at contact@thepointwizard.com if you suspect unauthorized access. One account is for one person; do not share, sell, or transfer it without our consent.
Point Wizard is an informational and organizational tool for loyalty points and award travel. We help you understand the value of your points, surface award redemption options, and prepare the steps to book — but you complete every booking and payment yourself, directly with the airline, hotel, or loyalty program.
We are not a travel agency, a seller of travel, a bank, or a financial institution, and we are not affiliated with, endorsed by, or sponsored by any airline, hotel, or loyalty program. Those programs are operated by third parties under their own terms.
The Free plan costs nothing. Paid plans (Wizard and First Class, individual or family) are offered on a recurring monthly or annual basis and are billed in advance through our payment processor, Stripe.
Free trial: paid plans may start with a 7-day free trial. If a trial applies, your payment method is saved at sign-up, you are not charged during the trial, and — unless you cancel before the trial ends — your subscription automatically converts to a paid, recurring subscription and your payment method is charged.
Automatic renewal & authorization: by starting a paid plan, you authorize us, through Stripe, to automatically charge your payment method the then-current subscription fee plus applicable taxes at the start of each billing period. YOUR SUBSCRIPTION AUTOMATICALLY RENEWS at the end of each period until you cancel.
Cancellation: you can cancel anytime from Settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period, and access continues until then. We may change prices or plan features and will give reasonable advance notice of any price increase that affects you. Prices are exclusive of taxes, which may be added where required.
Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, or unused features. When you cancel, you keep access through the period you have already paid for.
Travel advisors and agencies may subscribe to a partner plan and invite their clients. Partner fees are billed annually. A partner agency is an independent business; it is not our agent, employee, or representative, and it cannot bind us or make promises on our behalf. If you join through a partner agency, your use of the Service is still governed by these Terms.
Use the Service only for managing your own loyalty programs and travel, and in compliance with all applicable laws and the rules of the loyalty programs you use. Do not misuse the Service — for example, do not attempt to disrupt or probe it, access other users’ data, scrape or resell it, circumvent usage or access limits, reverse engineer it, or use it to violate any program’s terms.
When you approve a redemption, Point Wizard prepares the required point transfers and award details and guides you through completing it. You place the final booking and make any payment yourself, directly with the relevant programs and providers.
Loyalty programs set their own award rules, transfer ratios, availability, fees, and devaluations, which can change at any time and which control the final booking. We do not guarantee award availability, point values, transfer times, or that any particular redemption will be possible, and we are not responsible for the acts or omissions of airlines, hotels, programs, or other third parties.
If you choose to link accounts, we use our connectivity provider (Plaid) to obtain read-only information such as balances and transactions. We do not receive or store your bank or loyalty-program passwords, and we cannot move money, make transactions, or transfer points on your behalf. You can disconnect a linked account at any time. Your connection is also subject to Plaid’s end-user terms and privacy policy.
The Service provides information and tools about loyalty points and award travel. It is not financial, tax, investment, or professional travel advice, and we are not a licensed financial advisor. You are responsible for your own decisions.
The Service, including its software, design, text, and branding, is owned by Point Wizard or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal (or, for partners, internal business) use. You retain your own data and grant us the rights needed to operate the Service for you.
If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction or obligation to you.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any estimate, valuation, or recommendation will be accurate or achievable. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the fullest extent permitted by law, Point Wizard and its officers, members, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of points, awards, profits, goodwill, or data, arising out of or relating to the Service, even if advised of the possibility. Our total liability for any and all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Point Wizard from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
Please read this section carefully — it affects your legal rights. Except for the informal step in Section 17, you and Point Wizard agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Orange County, Florida, or remotely, and judgment on the award may be entered in any court with jurisdiction.
Class-action waiver: disputes will be brought only in your or our individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims. You and Point Wizard waive any right to a jury trial.
Opt-out: you may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing contact@thepointwizard.com with your name and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Before starting an arbitration or filing any claim, you agree to first contact us at contact@thepointwizard.com and try in good faith to resolve the dispute informally for at least 30 days. For any matter not subject to arbitration, the state and federal courts located in Orange County, Florida will have exclusive jurisdiction, and you consent to that venue.
These Terms and our Privacy Policy are the entire agreement between you and Point Wizard regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it.
You may not assign these Terms without our consent; we may assign them, for example in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. You consent to receive communications and legal notices from us electronically, including by email or through the Service.
We may update these Terms as the product evolves. We will post the new effective date at the top, and for material changes we will provide reasonable notice. Your continued use of the Service after an update means you accept the revised Terms.
